7)This LIC’s letter to Joint Secretary, MOF Dt. 31st December 2001, how carefully you managed to secure I do not know and preserved by you so long, is truly a precious and invaluable document, which reveals truth of LIC’s contemplation way back in 2001, in regard to pension upgradation to retirees and 100% DA neutralization to those of pre-August 1997 band. It certainly serves as a categorical, crystal clear and concrete weapon in the armoury of Sri Asthana before the Supreme Court both during Interim Application Submissions as also finally at the time of SLP Hearings and Proceedings. It is, however, unfortunate that such an important communication as this, sadly pertaining to our own pensioners’ matter, lost track of and shelved once and for all in a Government of India undertaking like LIC Corporate Office all these years without making any follow up with MOF and the Government of India itself was silent and remained in such long slumber without any action. It is almost a forgotten chapter at both the ends with the change of guards and generations to the absolute detriment of senior citizens’ community. This should necessarily be brought to the notice of the Supreme Court for the great injustice done to us.

Moreover, the word “prospective effect” used then must be interpreted to be from date 1st day of August 1997 as the cut off date, being the issue itself related to that date prior, and since the proposal and recommendation covers the period for pensioners applicable from 1st day of January 1986 to 31st day of July 1997, as otherwise, inference may be drawn as ‘retrospective effect’ for the respective pensioners retired as from 1st day of January 1986 onwards up to 31st day of July 1997 according to their dates of retirement and to avoid that contingency, guardedly it might have been used as “prospective effect.” It is not to dilly-dally for decades like this and still take advantage of the clause as writing on the wall as “tomorrow,” which will always be ahead and forwards.

This letter seems to be more clarified, more revealing and more strong and effective than the Board Resolution itself as regards the tenor and spirit of the pensioners’ issues at stake and exposes LIC’s fallacy and foul play in twisting facts to their advantage in their Counter Affidavit to the Contempt Petition and SLPs. It is better that we keep this shield in our fold, keep calm for the time being, and shoot at unawares to LIC on the eventful day appropriately, lest should they come to know of it before hand, they may try to make some cover up and give a different sort of build up to protect their skin and come clean about. Accordingly, you discuss with Sri Asthana and plan for projecting and focusing this at the right moment. This may be enjoined with Sri V.R.Krishna Iyer’s letter to former FM Sri Pranab Mukherjee also, which gives further reinforcement of the plea before the SC Judges.

13)I thank you very much for a copy of the beautiful hand book of our Charter of Demands presented to our Chairman by our esteemed Organisation recd. just now. The PROLOGUE compiled by you present a very comprehensive for older peoples demands as per the resolutions of the United Nations and Govt. of India. Most of us may not know about the said resolutions. If the GOI is really interested in their National Policy on Older persons, adopted as far back in Jan 1999, all our justified demands can be accepted by the management without any discussion. But these people have no time to look back and are fully engaged in fighting with Mr. Aravind Kejriwal & party in order to protect their ill gotten wealth running many many crores. 14)Very nice. Thank you very much for the nice portraying of what transpired in the court on 10th October 2012 step by step as if we are physically present and witnessing the court proceedings. It is like a teleprinter message directly received from Asthana at Delhi, similar to what used to happen in LIC offices up to two decades back for passing on communications/promotion orders etc. before computers came into vogue. How difficult it is to ascertain so many details on phone and to convey comprehensively in seriatim without leaving anything that the members generally like to know to their absolute satisfaction! The morale of the members certainly boosts up with your step and action. In granting 1 week's time only against 2 weeks requirement by the LIC counsel, SC displayed great reasonableness and at the same time, gave indication of a message that they are not in favour of such requests anymore and adjourned the case to 17th October 2012.

I wish to suggest is it possible for us to add a plea for the 5th Oct crucial hearing wherein the SC will give a clarification as to the scope and application of the Nov 2011 interim order on revision/upgradation of pensions to all LIC pensioners, that the LIC gives a commitment as to the date when they shall implement the Courts decision.

Hopefully this will be the last stage of our battle for increase in pension every time salaries are revised.

Is it not ironic that for senior citizens above 80 years the non taxable limit is Rs 5 lakh; while our retirees over 80 years of age do not have annual pension of even 1 Lakh.

The GOI's attitude is very callous and painful to all of us.

14) Dear RKV,

i)Please do not withdraw the cases without seeing the Jaipur judgment.For a mail that I addressed to Mr Asthana,he replied that this was a case where difference in gratuity was paid, but pension was not revised.He had communicated the HC decision as dictated in the court room.I am still not sure whether, it applies to people like you or whether it applies to people who were covered by the judgment in the gratuity case( retirees of 93-94).

If it is a case applying to Class I officers who retired fro August 1992 to 31/3/1993, then the question of payment of arrears of difference in salary from 1/8/1992 to the date of retirement also will arise.But the judge has only ordered revision of pension w.e.f 1/8/1997 in this case. So we have to see the judgment to get a clear picture.

14)ii)I thank you for conveying the Jaipur court judgement which went in favour of M.C.Jain as i also fit into the same case and could be a beneficiary.The only point over which LIC could reiy upon is that pension is fixed according to the 10 months average basic salary drawn at the time of retirement and therefore the retrospective date for revised salary may not be applicable although the pensioner was in service when the retrspective date came into effect.This argument get nullified by the Supreme court judgement in a similar case under case NO Appeal(Civil)NO 1289/2007 (Para 25) which read :"The revision of scales of pay as also other allowances is technical in nature. When a benefit is extended to group of employees the effect of such benefit if otherwise comes within the purview thereof must be held to be applicable to other group of employees" and the Jaipur court judgement was in tune with this Apex court verdict.

>M/S Kurup and Krishnan who also fall under the above category have filed CWP in Kerala HC.LIC may now take the stand to await the judgement in this court and to their convenience appeal against the Jaipur court judgement.C.S.Murthy was instrumental in filing this case in the Kerala H.C.Would you think that it would be wise for the Petitioners to withdraw their case at this juncture after consulting their counsel and i think Murthi could take the initiative.

I am writing this to u as Murthi is based in Hyderabad and u will be able to get some news .

17)Dear Sri Kishore, Even though our acquaintance extends to five decades from your coming to Machilipatnam Divisional Office as the second batch direct recruit of 1962 for practical training, whilst I was working at the time as Section Head in the Claims Department of that vast DO in the country itself then, with no officers in between up to ADM level, and although I was knowing and watching your spectacular turn up and feats there afterwards, I didn't have this in depth knowledge of you and your complete profile.

I am now deeply pleased to have a glimpse of your multi-dimensional outstanding achievements through your great, wonderful and brilliant autobiographical sketch and your astounding and exemplary profile of appreciable and enviable character at the same time, -------------------- We all, as you do, nay, every speck of that generation, come from middle class families only or some even from worse state of affairs too, and all, more or less passed through very many similar or even much tragic circumstances, situations, sufferings and experiences. I have read the draft of Charter of Demand prepared by Shri R B Kishore. It is drafted in a nice manner. It not only covers the demands of the pensioners but also gives a convincing reasoning for each demand.

I compiled the charter of demand on the basis of Banks Charter which was forwarded by Shri Kishore along with some earlier mail. Most of the demands are based on the resolutions passed in the Ujjain General Council Meeting.

Now. since a comprehensive, rational and logical charter is prepared by Shri Kishore Sahab, it should be submitted without making any change and at the earliest possible.

5)Dear Shri Kishore, This is a land mark judgement by the apex court and coming at the appropriate time when Asthana's suit is in the melting pot awaiting SC verdict in his favour, nay in favour of every pensioner for whom he waged a relentless battle at the cost of his health and finance.The most important part of the judgement as far as we are concerned is the apex court directive to the UOI to pay interest at the rate of 6% from 1-1-2006 to all the officers whether or not they have filed any petition before any of the High courts. The Bench directed that all pending petitions before any of the High courts by similarly placed officers be governed by this order. This sets at rest all the controversies being talked about.

I entirely agree with Sri Mahadevan on the point of “Pensioners’ E-mails & Feed Back,” resembling partaking in a practical assembly of retirees every fortnight, just as video conferences held in various offices for in-service executives, with the difference that in the former, there is amusement, fun and enjoyment and in the latter, there are impositions and answerability, making them tense and apprehensive and be on their toes. The pensioners look to them with eagerness and refreshing enthusiasm from the comfort of their home.

R K Laxman once remarked: “Readers of the Times of India every morning look at my ‘You said it’ cartoon with amusement for less than half a minute. To give them this daily pleasure the toil that I would have undergone the previous day one will hardly know.”

Somewhat akin is the plight of the compiler and organizer of the fortnightly pensioners’ e-mails and feed back bulletin released every fortnight promptly and with precision by you, in between, with so many multifarious self- designed and imposed projects and activities set before you, like pensioners’ charter of demands, suggestions for pensioners’ portal etc. to name only a few, besides assisting Sri Asthana in ever so many ways on the legal front, plus as is and as if not sufficient and free, most laborious and time-consuming CCC every month, which requires only an eagle eye and a razor sharp brain and nothing short of it, ever many times even at the burning of the midnight oil too. The bulletin of the fortnight, as it is appeared, is no doubt the delight of the readers but it might not be realized that the compiler had gone through a sort of struggle, exertion and effort through out the fortnight with a spate of mails pouring in, day in and day out, collecting, selecting and compiling, orderly putting forth them in a methodical, systematic and appropriate manner and way of presenting them as a well prepared and beautifully finished product to the sweet pleasure of the reader pensioners as a sort of relaxation, recreation and rejuvenation for one and all. It is perplexing how God is injecting and reinforcing that extraordinary energies and strength in you to withstand such enormous amount of strain and carry out all your endeavours in a record way! “God, the Great Giver, can open the whole universe to our gaze in the narrow space of a single lane.” – Tagore.

12(ii)Dear Kishore

In a judgement dt. 4-9-2012, relating to Indian Armed Forces, a bench of Justices R.M. Lodha, T.S.Thakur and AR Dave directed CGto APPROPRIATELY FIX RANK PAY, introduced to pay them a little more than their civilian counterparts to attract youth to make a career in the Armed forces,and DISBURSE ARREARS since 1-1-1986. This is music to the ears of all LIC Pensioners.

The grievance of officers in Armed forces arose from the WRONG FIXATION of RANK PAY as awarded by the 4th Pay comm.,in which the element of Rank Pay was introduced for ranks from Captain to Brigadier in the Army and their equivalent ranks in the Airforce and Navy, in addition to pay in the integrated scale.

It was Major Dhanapalan who petitioned the Kerala HC who had directed CG for proper fixation of Rank Pay from 1-1-1986,and payment of arrears with 6% interest.HC in their Order of 8-3-2010agreedwith Kerala HC. The CG’s application for modification of above SC order stands rejected by the 3-member Bench of SC on 4-9-12 and the CG has been asked to pay interest of 6% to be calculated from 1-1-2006(the dt. Of implementation of 6th Pay Comm. Recommendations)

Many of the principles & equity the matter of pay& compensation contained in the above SC directive shd. Be equally applicable to our LIC pensioners’ case now pending with SC.:

The grievance of the Army officers arose from “wrong fixation of Rank Pay.” In our case the grievances are:

a. wrong fixation of DR from commencement of pensionscheme (rectification of DA-DR anomalyformula,

b. non-implementation of LIC Board Resolution of 24-11-20001,

c. artificial bifurcation of pensioners into pre-1997 and post1997 pensioners with the sole view to shut all future benefits to the pre1997 retirees which is discriminatory.

d. no automatic revision for pensioners with every wage revision(1997,2002,2007,..) for in-service employees,(e)unsympathetic attitude and (f)delaying tactics followed by LIC Mgmt. & CG against a small number of pensioners who are becoming closed category and a vanishing species, many of whom are very aged and in their 70s and 80s.

All the Court verdicts are in favour of LIC pensioners, ie, the pattern(or %) of DR for pensioners should, be the same as that of in-service employees, LIC Board Resolution of 24-11-2001 should. Be implemented w.e.f. that date, all pensioners form one single group only and cannot be divided into pre1997 and post 1997 groups for purposes of benefits accruing to them and that there should. Be simultaneous revision of pension for all retirees whenever there is a revision of pay for in-service employees.

Hence can we reasonably expect the following directions in our favour from SC to CG & LIC Mgmt?

Wage revisions in CG take place once in 10 years, and SC has directed the CG to disburse the arrears since 1-1-1986(ie the dt.of implementation of 4th Pay Comm.) and to pay interest of 6% to be calculatedfrom 1-1-2006(the date of implementation of 6th Pay Comm). In LIC, wage revisions take place once in 5 yrs,wef1-8-97, 1-8-2oo2, 1-8-2007 and so on.

I think we can claim interest on arrears as under:

(a) The arrears arising out of rectification of DA-DR anomaly payable from date of retirement of the LIC pensioners to24-11-2001(dt. Of LIC Board Resolution) to be arrived at and interest at 6% payable on that amount we f24-11-2001 up to date of disbursement of arrears;

(b) The arrears arising out of revision of pension wef1-8-97 to 31-7-2002 as also amounts due arising out of implementation of Board Resolution of 24-11-2001 to be arrived at and interest at 6%payable on that amount wef 24-11-2001 to the date of disbursement of arrears;

(c) The arrears arising out of revision of pension wef 1-8-2002 to 31-7-2007 is payable with interest at 6% wef 1-8-2002 to date of disbursement of arrears;

(d) We may not now claim interest on arrears arising out of revision of pension wef 1-8-2007 to 31-7-2012 if the arrears in toto are paid before the end of 2012.

There are different streams of arrears due to us as given above from (a) to (d) . I have tried to be rational to arrive at the DIFFERENT EFFECTIVE DATES from which interest of 6% is to be claimed for the different streams of arrears. Am I sounding logical? Also the fact that wage revisions for CG are once in 10 years, while are once in 5 yrs. also creates some headache. You may examine and I am sure U will find a reasonable solution.

It must be noted that tho it was Major Dhanapalan who petitioned Kerala HC, it is stated that SC order dt. 4-9-2012 would apply to all officers of army, navy, and airforce, both serving and RETIRED, irrespective of whether they filed petition in court or the Armed Forces Tribunal. In abiding by SC order, CG could face a liability of close to Rs.1600 crores.

What is more, in the above case the SC has given a deadline of 3 MONTHS ONLY to CG for disbursement of arrears to the army officers. Our numbers being much smaller, the deadline should be a shorter period for the settlement of LIC pensioners’ arrears.

I hope and pray that all our pensionary arrear claims are fully settled and arrears fully disbursed to us before the end of this year 2012. -------R.V.RAMESH

When Kannadasan has given his description of the Mahaswami it cannot be just casual.If Mahaperiava is an ascetic of spiritual reverence,Kannadasan although in Grihasthasrama had the streaks of spirituality in him as a poet amply demonstrated to the Tamil film music lovers of our generation.It is great that he has educated the masses on the greatness of Mahaswami as a spiritual guide , master and leader irrespective of the castes of the people at large. iii)I send a Chart prepared by me showing the yawning gap between the average rate of annual increase in in-service salaries and gross pension of retirees over 15,10 and 5 years as at 1/8/2012 despite linking of DR with pension.I have already sent it to Mr G.N.Sridharan.

It will be clear therefrom that the so called 100% DR neutralisation applicable to pensioners retired from 1/8/1997 is in fact a myth.

Nothing short of upgradation of pension with every wage revision will result in 100% DR neutralsation in the long run.Interestingly the gap is highest in respect of pensioners who retired between 1/8/2002 and 31/7/2007.5 or 10 years down the line they are going to be the hardest hit in terms of disparities.

It is therefore high time that we focused on wholesale upgradation of pension rather than on the truncated benefit for the pre-August 1997 retirees only.

Such a focus will help 100% of pensioners and avoid division of the whole population of pensioners along the dividing line of retirement date.

Contribution to PF shall be at the rate of 10% of the revised pay and with equal

contribution by the employer to the PF/Pension fund as the case may be.
All the employees shall be governed under the 1995 Pension Scheme.

Every employee shall be eligible for full pension after completing 20 years of

service. There shall be up gradation of pension after every wage settlement.

DA neutralisation shall be 100% to all the employees retired before August,

1997.”
The above is the exact wording used in the CHARTER OF DEMANDS OF AIIEA.

Planning Commission vide their letter no. M-11012/4/2011-SJ & SW dt 9-7-12 received on 17-8-12 in reply to RTI Appeal has sent a Report of XII Five Year Plan (2012-17) Working Group on ``Social Welfare``(October, 2011), which gives the following important information about provisions recommended for Senior Citizens in XII th Plan with justification. XII th Plan is not yet finalized and notified.

1. Non-Scheme Recommendations:

a) Para 2.9.1: Need for setting up a Separate Department of Senior Citizens is recommended.

b) Para 2.9.2: Need for Setting up a National Commission for Senior Citizens is recommended.

c) Para 2.9.11: A Weekly Programme of One Hour Duration should be introduced in Doordarshan on various issues & concerns relating to senior citizens viz Health Care, Security, need for care & maintenance etc.

2. Para 2.8.3: Rashtriya Swasthya Bima Yojna (RSBY): To provide insurance to the extent of Rs 1 lakh in place of existing Rs 30000. Provision recommended Rs 2500 crore.

3. Para 2.8.5: Enhanced Monthly Pension under Indira Gandhi National Old Age Pension (IGNOPAS): Present amount of Rs 200 from Central Govt should be increased to Rs 500 p.m. to those below 80 and amount of Rs 500 to be enhanced to Rs 1000 p.m. to above 80 with efforts to be made to ensure that all States/UTs give matching share. 12)I have the proud privilege and pleasure of having a look at the counter affidavit of Chairman with the valuable comments of revered Sri C.H. Mahadevan.

The Chairman’s counter is no doubt very competently drafted and that much of protection and defence was expected and called for on their part, for the violent, vehement and effective contempt petition filed by Sri Asthana, though everything what they stated were not all fool-proof and correct. Ever so many things they misconstrued and misinterpreted confused and side-tracked the issues ignorantly to an extent that the court also may take quite some time to understand what is what and arrive at a proper conclusion. SC only has to hit and teach them a lesson.

Sri Mahadevan’s comments are all very nice and apt, worthy of his caliber and station, exposing the illogicality of LIC’s reasoning and they would go a long way and do well with Sri Asthana to prepare himself further on, not that he does not know, but they would alert him, supplement and serve as a good guidance for him to face the opponent on the fateful day in the battle-field. If only of Sri Mahadevan’s or yourselves’ well-versed and well-informed persons were there in the Central Office at the helm of affairs, pensioners’ matters would have been settled long back without any court hassles, hurdles and hitches! But as I mentioned elsewhere earlier in another context, such men are now wanting and incompetence, incomprehension, inefficiency, ignorance and dependency rules over the day everywhere and LIC is no exception. “O judgement! Thou art fled to brutish beasts, And men have lost their reason.” – Shakespeare: Julius Caesar. Nevertheless, justice prevails and stands to reason. “Justice is an unassailable fortress, built on the brow of a mountain which cannot be overthrown by the violence of torrents, nor demolished by the force of armies.” The Koran. 17)Re: Fw: Withholding Gratuity of Officers on flimsy ground is bad in law - says Gujarat High Court

Dear Mr Kishore,

This is a landmark judgment.Perhaps the Bank may appeal against the judgment.But I have suggested to two of the retired officers in Hyderabad whose benefits were withheld but subsequently paid without punishment to claim interest for delayed payment.We may bring it to the notice of retired employees who would have suffered without justification on this count.
